2. General information

This policy explains which personal data is processed when you visit and use schmidtpabst.com. Personal data is processed only where a legal basis exists — in particular Article 6(1)(a) GDPR for consent, Article 6(1)(b) GDPR for requested services and pre-contractual communication, and Article 6(1)(f) GDPR for legitimate interests.

3. Hosting and server logs

The website and its Ghost installation run on a virtual server operated by IONOS SE, Elgendorfer Straße 57, 56410 Montabaur, Germany. The server is located within the European Union.

When you visit the site, the server processes technically necessary connection data: IP address, date and time, requested address and volume transferred, referrer, browser type and version, operating system, HTTP status code and other technical connection data.

This is necessary to deliver the site securely, analyse faults and prevent misuse. Legal basis: Article 6(1)(f) GDPR. Log data is deleted or anonymised as soon as it is no longer required, unless statutory retention duties or a specific security incident require longer storage.

4. Ghost and free membership

Ghost, an open-source publishing system, is used for content and free memberships. It runs on my own IONOS server. This is not Ghost(Pro); member data is not transmitted to the Ghost Foundation.

When a free membership is created, Ghost processes your email address, your name where voluntarily provided, an internal member ID, sign-up and confirmation status with timestamps, newsletter settings, and technical sign-in data.

Membership uses no password — sign-in works through a time-limited link sent by email. Legal basis: Article 6(1)(b) GDPR. No paid memberships are offered.

Unsubscribing from the newsletter does not automatically delete your membership. Full deletion can be requested at arthur@schmidtpabst.com.

5. Confirmation, sign-in and contact messages via Proton Mail

Registration confirmations, newsletter confirmations, passwordless sign-in emails and messages forwarded from the contact form are sent through Proton Mail.

Provider: Proton AG, Route de la Galaise 32, 1228 Plan-les-Ouates, Geneva, Switzerland.

Processed data includes recipient address, sender details, subject, message content and the technical data required for delivery.

Legal basis: Article 6(1)(b) GDPR for membership-related messages, and Article 6(1)(a) GDPR where a newsletter consent is being confirmed. Switzerland is covered by an adequacy decision of the European Commission. https://proton.me/legal/privacy

6. Newsletter, double opt-in and performance measurement

The newsletter is sent only after express subscription, using double opt-in: you enter your address; the subscription is stored as unconfirmed; a confirmation email is sent via Proton Mail; the subscription is activated only once you click the confirmation link.

As proof of consent, the time of sign-up, the time of confirmation, the consent status and the wording of the consent given are stored.

Performance measurement. By consenting to the newsletter you also consent to personalised performance measurement. Whether and when a newsletter is opened, and which links in it are clicked, is recorded, linked to your email address and evaluated in order to tailor the newsletter's content to recipients' interests and to determine its reach.

Legal basis for both dispatch and measurement: Article 6(1)(a) GDPR. Receiving the newsletter without performance measurement is not technically provided for; objecting to the measurement is therefore only possible by unsubscribing from the newsletter entirely.

You may withdraw consent at any time with effect for the future, via the unsubscribe link in every newsletter or by message to arthur@schmidtpabst.com. The lawfulness of processing before withdrawal is unaffected.

After unsubscribing, your address may remain on a suppression list where necessary to reliably prevent further mailings and to evidence the unsubscribe. Legal basis: Article 6(1)(f) GDPR.

7. Newsletter

"No newsletter is currently sent through this website. This privacy policy will be updated in advance once newsletter delivery is set up."

8. Contact form

The contact form processes your name (required), company or team (optional), email address (required), message (required) and the language version selected.

These details are not stored in any database on this website. They are forwarded immediately by email to the controller's mailbox and processed there as part of subsequent correspondence. Delivery is via Proton Mail (section 5).

Legal basis: Article 6(1)(b) GDPR where the enquiry concerns the initiation or performance of a contract, otherwise Article 6(1)(f) GDPR. Data is deleted once the enquiry has been dealt with and no statutory retention duties apply.

9. Contact by email or phone

Information you provide when contacting me by email or phone is processed to handle your request. Legal basis: Article 6(1)(b) or 6(1)(f) GDPR. Data is deleted once no longer needed.

10. Fonts and external files

Fonts. The fonts used on this website are served from our own server. There is no connection to Google Fonts and no data is transmitted to third parties for this purpose.

jsDelivr. Technically necessary JavaScript for Ghost's member and search functions is loaded from the jsDelivr CDN, operated by Volentio JSD Limited, Suite 2a1, Northside House, Mount Pleasant, Barnet, England EN4 9EB, United Kingdom. The UK is covered by an EU adequacy decision.

When these resources are requested, the providers necessarily receive your IP address, the date and time, the file requested, and browser and connection information. Legal basis: Article 6(1)(f) GDPR.

11. Cookies and local storage

Only technically necessary cookies and comparable storage are used — in particular for language selection, light/dark preference, member sign-in via sign-in links, and security-related state.

Legal basis for accessing information on your device: Section 25(2) TDDDG; for the subsequent processing of personal data: Article 6(1)(b) or 6(1)(f) GDPR.

No advertising or marketing cookies are used. No web analytics take place.

12. Recipients and processors

IONOS SE (hosting); Proton AG (confirmation, sign-in and contact messages)/ Volentio JSD Limited / jsDelivr and its infrastructure partners; Unsplash Inc. (images); technical service providers where required for maintenance, security or fault correction; authorities where disclosure is legally required.

Agreements under Article 28 GDPR are concluded with processors where legally required.

13. Retention

Where no specific period is stated above, personal data is stored only for as long as necessary for the relevant purpose, then deleted or anonymised, unless statutory retention duties, documentation of consent, or the establishment or defence of legal claims require longer storage.

14. Your rights

You have the rights of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction (Art. 18), data portability (Art. 20) and objection (Art. 21), and the right to withdraw consent under Art. 7(3) GDPR at any time with effect for the future. A message to arthur@schmidtpabst.com is sufficient.

15. Objection to processing based on legitimate interests

Where data is processed on the basis of Article 6(1)(f) GDPR, you may object at any time on grounds relating to your particular situation. Processing will then cease unless compelling legitimate grounds override your interests, or the processing serves to establish or defend legal claims.

17. Security

Appropriate technical and organisational measures are taken to protect personal data against loss, misuse, unauthorised access and unlawful alteration. The website is transmitted encrypted over HTTPS.

18. Changes to this privacy policy

This policy will be adapted when the website, the services used, or legal requirements change. The version published on this website applies.
